These Terms of Service (“Terms”) govern your use of the Water Savvy website and mobile applications (the “Services”), operated by True Elements, Inc. Please read them carefully.
By accessing or using Water Savvy, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these terms.
Water Savvy provides information about water quality conditions, forecasts, alerts, and related educational content, drawing on public data sources and analytics provided by True Elements. We may add, change, or discontinue features at any time.
Water quality scores, conditions, forecasts, and alerts in Water Savvy are provided for general informational purposes only. They are not a substitute for official advisories, testing results, or guidance from your local water utility, public health department, or other government authorities.
Always follow official advisories. Do not rely solely on Water Savvy to make decisions about drinking water safety, swimming, or other activities that could affect your health.
Some features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use.
Water Savvy may allow you to submit observations, photos, and other content (“Contributions”). You retain ownership of your Contributions, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute them in connection with operating and promoting the Services.
You agree not to submit Contributions that are false or misleading, infringe others' rights, contain personal information about others without consent, or are unlawful, harmful, or abusive. We may remove Contributions at our discretion.
The Services, including all software, designs, text, graphics, logos, and data compilations (excluding your Contributions and third-party public data), are owned by True Elements, Inc. or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these terms.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that water quality information will be complete, current, or accurate.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUE ELEMENTS, INC. AND ITS OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING DECISIONS MADE BASED ON WATER QUALITY INFORMATION PRESENTED IN THE SERVICES.
You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these terms or if we reasonably believe your use poses a risk to the Services or other users. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will survive.
We may update these Terms of Service from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated terms.
